Terms of Service

Last Updated: October 10, 2026

1. Who We Are and About These Terms

Sylestia is an online pet collecting, battling, and exploration game available at www.sylestia.com. The game and this website are operated by Sylestia Games LLC, a limited liability company registered in the State of Kansas, United States. In these Terms of Service, the words "Sylestia", "we", "us", and "our" all refer to Sylestia Games LLC. "You" means anyone who visits our website or plays our game, whether or not you have an account.

These Terms of Service are the agreement between you and us. They set out the rules of the game, what you may and may not do, what belongs to you and what belongs to us, and the limits of our responsibility. By visiting our website, creating an account, or playing Sylestia, you agree to these Terms. If you do not agree with them, please do not use Sylestia.

These Terms cover the rules of the game and your account. What we do with your personal information is covered separately in our Privacy Policy, which forms part of your agreement with us. Please read both.

We have written these Terms in plain language wherever we can. A few of them carry legal weight that we cannot simplify without changing their meaning, in particular the disclaimers in Section 11 and the limits on liability in Section 12, and those are worded precisely on purpose.

If you have questions about these Terms, please see Section 15.

2. Eligibility and Age Requirements

Sylestia is intended for a broad audience and we ask everyone who plays to meet a small number of basic requirements.

You must be at least 13 years old to hold an account

We ask for your date of birth when you create your account and we do not allow an account to be created by anyone who tells us that they are under 13. If we find that an account was created by a child under 13, we close it. Our Privacy Policy explains how we handle information belonging to children.

Players under 18 need a parent or guardian to agree

If you are under 18, or under the age of majority where you live, you may use Sylestia only with the knowledge and consent of a parent or guardian, and they accept these Terms on your behalf.

Parents and guardians are responsible for supervision

If you are the parent or guardian of a player under 18, you are responsible for their use of the game, including any purchase made on the account. We also ask that you supervise what they share, because anything posted in a public part of the site can be read by anyone on the internet and may appear in search engine results.

Some countries set a higher age

In some countries the minimum age for using an online service without a parent's permission is higher than 13. If that is the case where you live, please make sure that you have your parent or guardian's permission before using Sylestia.

Returning after a ban is not permitted

If we have previously banned you from Sylestia, or banned or terminated your account for breaking these Terms, you may not create a new account or use Sylestia again unless we have agreed that you may.

3. Your Account

You need an account to play Sylestia. This section covers how many accounts you may hold, how to keep yours secure, and the names that you choose inside the game.

One account per player

You may hold only one Sylestia account. Players found using more than one account will have the additional accounts terminated and may be permanently banned.

Keep your details accurate

Please give accurate information when you create your account and keep the email address on your account current. It is how we reach you about security, account recovery, and anything important that happens to your account.

Your account is yours to protect

You are responsible for keeping your password and login details secure and for everything that happens on your account. We strongly recommend that you do not share your account or your login details with anyone. If you choose to share them, any harm that comes to your account is not our responsibility or liability. Please tell us straight away if you believe someone else has gained access to your account.

No impersonation

You may not attempt to pass yourself off as another player or as a member of our staff.

Accounts may not be sold, traded, or given away

Selling, buying, trading, or transferring a Sylestia account is strictly forbidden. Accounts found being sold or traded will be terminated and the players involved may be permanently banned.

Account names and pet names

The names that you choose, including your display name, your pet names, and anything else that you are able to name, must not be profane, offensive, or intended to harass. We retain the right to change any name on the site for any reason and without notice. Violations of this rule may result in a permanent ban.

4. Rules of Conduct

Sylestia is a community and that only works if players treat one another with respect and courtesy. These rules apply everywhere on the site (such as forums, private messages, chat, and profiles) as well as to our official Discord server, if you opt to join it.

Treat everyone with respect

You are expected to be respectful and courteous to other players and to our staff at all times.

No hate speech or discrimination

Sylestia does not condone hate speech or discrimination of any kind. This includes, but is not limited to, discrimination on the basis of race, ethnicity, national origin, gender, gender identity, sexual orientation, religion, disability, and age.

No harassment

You may not harass, threaten, insult, defame, or libel another player or our staff anywhere on the site. This includes behavior such as following another player around the site to continue an argument or deliberately setting out to spoil a particular player's enjoyment of the game.

No trolling

You may not deliberately provoke, bait, or antagonize other players or staff.

Please do not discuss banned players

Moderation decisions are a private matter between us and the player concerned, so please do not discuss banned players or their bans publicly. If you have a concern about a moderation decision, contact us directly and we will look at it.

Please do not publicly announce that you are leaving

Public farewell or quitting threads tend to invite drama rather than closure. If you would like to tell the friends that you have made that you are leaving, our private methods of communication are the correct place for it.

5. Content and Communications

This section covers what you post, send, and share on Sylestia (such as on the forums, in private messages, in chat, or on your profile) as well as on our official Discord server, if you opt to join it.

Post only what you have the right to post

You must own the content that you post or otherwise have the right to use it. Please do not post anything that would infringe another person's intellectual property, confidentiality, or privacy.

Nothing harmful, explicit, or private

You may not post or send harmful content, sexually explicit content, another player's or staff member's private information, or content that is offensive on the basis of the characteristics listed in Section 4.

Keep it lawful

You may not promote, encourage, or discuss illegal activity anywhere on Sylestia. You agree to use the site only for lawful purposes and not in any way that would constitute a criminal offense, give rise to liability, or otherwise breach any applicable local, state, national, or international law.

Language and the profanity filter

Sylestia is a PG-13 community. Our profanity filter is always on, it applies to every player, and it cannot be turned off. Milder language is tolerated, but strong profanity is filtered and swearing must never be aimed at another player or our staff. Display names, pet names, and anything else that you are able to name must pass the filter. You may not attempt to get around the filter or any other content filter, for example by altering spelling or substituting characters.

No spam

You may not spam in any form. This includes posting repeatedly about the same topic, bumping threads excessively, overusing emoticons, using excessive capitals, pinging players repeatedly, and sending unsolicited mass private messages (such as chain letters). A thread may be bumped once it is no longer on the first page of its forum.

Mark story spoilers

Please do not publicly spoil story content. If you want to discuss it, mark it clearly, such as by adding SPOILER to the thread subject or at the top of your post. Please keep the spoiler itself out of the thread title and do not discuss story spoilers in public chat.

Please do not beg

Please do not beg or ask other players or our staff for items, gold, Diamonds, or any other in-game asset.

No advertising other games

You may not use our forums, chat, or messages to recruit for or advertise another game or site. Simply talking about other games is perfectly fine.

Anything you post in a public area of Sylestia, such as the forums or your profile, can be read by anyone on the internet, including people who do not play Sylestia, and it may appear in search engine results. Please think carefully before sharing personal information about yourself that you would not want others to see.

6. Fair Play and Game Integrity

Sylestia only works if everyone is playing the same game. These rules protect that and we enforce them strictly.

No cheating or automation

You may not use any cheat, script, hack, bot, macro, or any other tool that is designed to play the game for you or to give you an unfair advantage.

Report bugs, do not exploit them

If you find a bug, glitch, or error, please report it to our staff straight away. You may not use it to your own advantage, and you may not promote it, encourage others to use it, or show them how.

No scamming, hacking, or theft

You may not scam another player, attempt to access an account that is not yours, steal passwords or private information, or take artwork or other protected material from Sylestia or from another player.

Do not interfere with the game

You may not attempt to disrupt, overload, damage, or gain unauthorized access to our website, our servers, our systems, or any other player's account.

Do not set out to harm the game

You may not use Sylestia, or any of its features, with the deliberate aim of damaging the game or the player experience for others. This includes valid individual actions (such as buying and selling in-game assets) if the intent is to cause harm.

7. Player Trading and Transactions

Sylestia lets players trade pets, items, and in-game currency with one another. This section explains the rules for those trades and where our responsibility begins and ends.

Trades between players

Trades of Sylestia's in-game assets must be arranged and carried out through Sylestia, using the features and the communication channels that we provide. Please take care when arranging a trade.

Trades may not involve real-life money

Sylestia's in-game assets may not be sold, bought, or exchanged for real-life money or for anything that takes the place of money, such as gift cards or cryptocurrency. This applies wherever the trade is arranged and whoever it is arranged with.

Trades may not involve other sites' assets

Sylestia's in-game assets may not be traded for assets that belong to another site or service. We have no control over what other sites and services offer, so we cannot confirm that a trade of this kind stays within these Terms.

Paying for creative work or in-game services

You may pay another player with in-game assets for creative work or for a service carried out within Sylestia. No real-life money may form any part of the exchange.

Player-run auctions, contests, and giveaways

If you run an auction, contest, giveaway, or similar event, you must set out a clear set of rules and a clear timetable for completion or delivery and then honor them. Failing to follow through on that obligation is treated as a form of scamming. Players who take part are covered by our guarantee in the same way as any other agreement.

Scamming

Scamming another player is one of the most serious breaches of these Terms. Players found scamming will face severe consequences, up to and including having their account permanently banned.

A trade that breaks these rules is not recognized by us and is not protected in any way. We are not a party to it, we have no way of verifying it, and we accept no responsibility or liability for it. We cannot recover in-game assets, reverse the trade, or settle any dispute that comes out of it, and taking part in one may result in action against your account.

However, we want you to be able to take part in the economy with confidence, so we stand behind any agreement that we are able to verify. An agreement is binding between the two players whether it was arranged through an in-game feature or agreed in our chat, on our forums, in private messages, or on our official Discord server. If you believe that another player has failed to uphold their side, please contact us and we will investigate. Where our records show that an agreement was made and not honored, we will either complete the trade as it was agreed or, where that is no longer possible, return what you gave so that you are made whole. Please allow at least 72 hours for the other player to follow through before contacting us.

8. Diamonds and Virtual Items

Diamonds are Sylestia's premium currency. You can buy them with real money and you can also obtain them from some in-game features. This section explains exactly what you are getting when you buy them.

What you are buying

When you buy Diamonds, you are buying a limited, personal, revocable license to use them inside Sylestia. You are not buying property, you have no right, title, or interest in Diamonds beyond that license, and the Diamonds themselves remain ours. Diamonds do not expire.

Transferring Diamonds

You may transfer Diamonds to another player using the features that we provide for it, such as the Currency Exchange. Section 7 covers the rules that apply to trades between players. Diamonds exist only inside Sylestia. They cannot be moved off the site, transferred to another service, or converted into anything outside the game.

Virtual items have no real-world value

Diamonds, pets, items, gold, and every other virtual asset in Sylestia have no monetary value outside the game. They are not money, they are not a stored balance, and they cannot be redeemed with us for cash.

Refunds

If you change your mind about a purchase, contact us within 14 days. If your Diamond balance is still at least the amount that you bought, we will take that amount back off your account and refund the payment. We can only refund while the Diamonds are there to take back, so once your balance falls below that amount we are not able to refund that purchase. Payments are otherwise non-refundable, except where a refund is required by law. We may decline a refund where this policy is being misused.

If you are in the European Economic Area or the United Kingdom

You normally have the right to withdraw from a purchase of digital content within 14 days. Diamonds are added to your account as soon as your payment is received. By completing a purchase, you ask us to deliver them immediately and you accept that your right to withdraw ends once they have been delivered. Nothing here affects any other right you have under the consumer law of the country where you live.

Pay with your own funds

Any purchase of Diamonds must be made using a payment method that belongs to you or that you have the account holder's permission to use. If you are under the age of majority where you live, you may only buy Diamonds with the involvement of your parent or guardian, as described in Section 2.

Never start a chargeback

Starting a chargeback or a payment reversal will result in the termination of your account and a permanent ban from Sylestia. If something has gone wrong with a purchase, contact us first and we will happily work with you.

We may change or discontinue virtual items

We may add, change, remove, or discontinue Diamonds, any virtual item, any game feature, or Sylestia itself at any time. We may also adjust prices. We will not owe you compensation for a change of that kind, and Diamonds or virtual items that you hold cannot be exchanged for money if it happens.

How payments are handled

Diamond purchases are processed through PayPal in US dollars, so we never see or store your card or bank details. Our Privacy Policy describes the purchase records that we do keep.

If your account is terminated because you broke these Terms, you will lose access to everything on it, including any Diamonds that you have bought and any virtual items that you hold. Those will not be refunded.

9. Intellectual Property and Ownership

This section explains who owns what: the game itself, the things that you create and post, and the images that you would like to share. It also covers our design contests and what to do if you believe that something here infringes your copyright.

What we own

Everything that makes up Sylestia belongs either to Sylestia Games LLC or to its respective owner, and all of it is protected by copyright and other laws. For example, the pets, the avatars, our characters and species, our artwork, and the Sylestia name and logo are all ours. Where a part of the site belongs to someone else, we use it under license or with permission and it remains theirs. Nothing in these Terms transfers any of it to you, and you may not copy, extract, or reuse any of it except where these Terms say that you may.

The same is true of everything inside the game. For example, the individual pets that you collect and breed, the individual items that you hold, your currencies and your Diamonds, and the records attached to them are all part of Sylestia and remain ours. Your account gives you a personal license to use them within the game, as described in Section 8, and nothing more.

Please do not use the Sylestia name or logo in a way that suggests we endorse or are associated with something when we are not.

What you post

You keep ownership of the original content that you create and post on Sylestia, such as your forum posts and your artwork. You are responsible for what you post.

We do not review what players post before it appears. Something appearing on Sylestia does not mean that we endorse it or agree with it. Content that breaks these Terms is dealt with under Section 10.

When you post or submit anything to us that relates to Sylestia, including artwork, suggestions, ideas, contest entries, and any other derivative work, you grant Sylestia Games LLC a worldwide, royalty-free, irrevocable, perpetual, and non-exclusive right to use, store, copy, edit, modify, adapt, publish, and display it in connection with Sylestia. You also waive any moral rights in that material, to the extent the law allows you to.

This matters most for suggestions. If you propose an idea and we later build something like it, we are free to do so and we are not obliged to compensate you for it. It is not a promise that we will use anything that you send and it does not stop you from using your own content elsewhere.

Design contests

We run design contests from time to time and invite players to submit their own ideas and artwork. Entering one grants us the rights described above over your entry.

If your entry is selected, we may use it directly or treat it as a reference for artwork that our own artists produce. Either way, the finished work that goes into the game belongs to us, and being selected does not give you ownership of it or any claim over it.

Each contest sets out its own rules, including any prize that goes with it. Entering does not entitle you to anything beyond what those rules say. If you do not agree with the terms set out here, you are free not to enter.

Using Sylestia images

You are welcome to share Sylestia images on personal web pages and on social media, including your pets, your avatar, and screenshots of the game. Please credit Sylestia Games LLC as the copyright holder.

You may not sell them, use them commercially, or present them as your own work. Anything beyond personal use needs our written permission.

Fan art

You are welcome to create your own artwork based on Sylestia, such as drawings of your pets or of our species, and to share it for free.

What you draw is your own work, but it is built on ours, so you may not sell it, use it commercially, or make merchandise from it without our written permission.

Reporting copyright infringement

If you believe that something on Sylestia infringes your copyright, the form on our Copyright and DMCA page asks for everything a notice needs and delivers it straight to our designated copyright agent. You are welcome to write to the agent directly instead.

Copyright Agent, Sylestia Games LLC
4601 E. Douglas Ave. STE 150
Wichita, KS 67218
United States
Phone: (316) 347-7562
Email: dmca@sylestia.com

However you choose to send it, a notice is only effective if it includes all of the following.

  • Your signature, either physical or electronic.
  • Identification of the work that you say has been infringed.
  • Identification of the material to remove, and where to find it on Sylestia.
  • Your name, address, telephone number, and email address.
  • A statement that you believe in good faith that the use is not authorized.
  • A statement, under penalty of perjury, that your notice is accurate and that you are the owner or are authorized to act for them.

We remove content that infringes someone else's rights, and we may ban the account of anyone who does so repeatedly. This covers links that players post as well as anything stored on Sylestia itself.

Please be careful about what you send. Knowingly claiming that material is infringing when it is not can make you liable for the costs and damages that the false claim causes.

If your content was removed by mistake

If we remove something that you posted, we will let you know. If you believe it was removed by mistake or that it was misidentified, you may send a counter notice to the agent listed above. The form on our Copyright and DMCA page takes takedown notices only, so a counter notice has to reach the agent by email or by post.

A counter notice needs to include all of the following.

  • Your signature, either physical or electronic.
  • Identification of the material that was removed, and where it used to appear.
  • A statement, under penalty of perjury, that you believe it was removed by mistake or misidentified.
  • Your name, address, and telephone number.
  • Your consent to the jurisdiction of the federal court where you live, or any district where we may be found if you are outside the United States.
  • Your agreement to accept service of process from the person who sent the notice.

We will pass your counter notice to the person who sent the original complaint. If they do not go to court to stop you from restoring the material, we may put it back between 10 and 14 business days after we receive your counter notice.

10. Enforcement, Suspension, and Termination

This section explains what happens when these Terms are broken and how either of us can bring things to an end.

Depending on what has happened, we may take any of the following steps.

  • Issue a warning.
  • Remove or edit content that breaks these Terms.
  • Change a name that breaks our naming rules.
  • Restrict or remove access to a feature, such as the forums or chat.
  • Suspend an account, so that it cannot be used for a period of time.
  • Ban an account, so that it can no longer be logged into.
  • Terminate an account, so that it and everything on it is removed.
  • Ban a player from Sylestia, so that they may not return under a new account.
  • Block access from the connection or device that was used.

We may end your access at any time

Sylestia may suspend, ban, or terminate your account, or remove your access to any part of the site, at any time, with or without cause, with or without notice, and effective immediately. By creating an account and using Sylestia, you agree to this. We are not required to explain the decision and we are not required to reinstate an account.

How we usually handle it

In practice, we would far rather keep a player than lose one. A first mistake or a small violation usually draws a warning, and someone who understands what went wrong is usually welcome to carry on. The more serious or the more deliberate the breach, the more serious our response. None of this limits the right set out above.

Repeat copyright infringement

We ban the account of anyone who repeatedly infringes someone else's copyright. Section 9 explains how to report infringement and how to respond if your own content is removed.

If you think we got it wrong

You can appeal a suspension or a ban through our Contact Us page. Tell us what happened and we will take another look. The final decision rests with us.

You may leave at any time

If you wish to end this agreement, you can simply stop using Sylestia. If you would like your account closed, or your personal information deleted, our Privacy Policy explains how to ask and what we are able to do.

What still applies after you leave

Ending your account does not end everything in these Terms. A few parts carry on afterwards, because they would mean nothing if they stopped the moment somebody left. We still own the game and everything in it, as set out in Section 9. The disclaimers in Section 11 still apply to anything that happened while you were playing. So do the limits on liability and the indemnity in Section 12. Section 13 still governs any dispute between us.

11. Disclaimer of Warranties

Sylestia is provided "as is" and "as available", without warranty of any kind. To the fullest extent permitted by law, Sylestia Games LLC and its suppliers and licensors disclaim all warranties, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that Sylestia will be uninterrupted, timely, secure, or error free, that any defect will be corrected, or that our site or the servers that run it are free of harmful components. You understand that you use Sylestia, and download or otherwise obtain content through it, at your own discretion and at your own risk.

No advice or information that you get from us, whether spoken or written, creates any warranty that is not stated here.

We take real care with your account and your pets, and we keep backups, but no online service can promise that data is never lost. We do not guarantee that your account, your pets, your items, or your progress will always be preserved.

Some jurisdictions do not allow the exclusion of certain warranties. If you live in one of them, some of the above may not apply to you, and our warranties are instead limited to the shortest period and the smallest extent that the law permits.

12. Limitation of Liability and Indemnification

To the fullest extent permitted by law, Sylestia Games LLC, its owners, staff, contractors, suppliers, and licensors will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, nor for any loss of profits, loss of data, loss of goodwill, or loss of virtual assets, arising out of or relating in any way to your use of, or inability to use, Sylestia, its content, or any third party site linked from it. This applies whether the claim is based in contract, negligence, or any other legal theory, and whether or not we have been advised that such damages were possible.

We are not liable for the conduct of any player, including conduct that is defamatory, offensive, or unlawful, and we are not liable for any transaction between players.

To the fullest extent permitted by law, our total liability to you for all claims relating to Sylestia will not exceed the greater of the total amount you paid us in the twelve months before the claim arose, or one hundred US dollars.

If you are dissatisfied with Sylestia, your sole and exclusive remedy is to stop using it.

Nothing above limits our liability where the law does not allow it to be limited. That includes liability for fraud, for gross negligence or willful misconduct, and for death or personal injury caused by our negligence.

Some jurisdictions do not allow the exclusion or limitation of certain damages. If you live in one of them, some of the above may not apply to you, and our liability is instead limited to the smallest extent that the law permits.

Indemnification

You agree to indemnify and hold harmless Sylestia Games LLC, its owners, staff, contractors, and licensors, and their respective directors, officers, employees, and agents, from and against any and all claims, damages, losses, liabilities, and expenses, including reasonable legal fees, arising out of your use of Sylestia, the content you post, or your breach of these Terms.

13. Governing Law and Disputes

This section covers which law applies to these Terms, where a dispute between us would be heard, and a few general rules about how this agreement works.

Governing law

These Terms, and any dispute arising out of them or out of your use of Sylestia, are governed by the laws of the State of Kansas, United States, without regard to its conflict of law rules.

Where disputes are heard

You and Sylestia Games LLC agree that any dispute will be brought exclusively in the state or federal courts located in the State of Kansas, and you consent to the personal jurisdiction of those courts.

If you are a consumer outside the United States

Nothing in these Terms takes away any protection you have under the mandatory consumer law of the country where you live. If you are a consumer in the European Economic Area or the United Kingdom, you may also bring proceedings in the courts of your country of residence.

Please talk to us first

Most problems are far easier to sort out by talking to us. Before starting any formal proceedings, please contact us using the details in Section 15 and give us a fair chance to put things right.

Time limit for bringing a claim

Any claim relating to these Terms or to your use of Sylestia must be brought within one year of the date it arose. A claim brought after that is too late. This does not apply where the law where you live does not allow a limit that short.

If part of these Terms cannot be enforced

The rest of them remain in full effect and the part that cannot be enforced is applied to the greatest extent the law allows.

These Terms are the entire agreement

These Terms and our Privacy Policy together are the entire agreement between you and Sylestia Games LLC about your use of the game. They replace anything said or written before.

If we do not enforce a provision straight away

That is not a waiver of it and we may still enforce it later.

Transferring these Terms

You may not transfer your rights under these Terms to anyone else. We may transfer ours in connection with a sale or transfer of the business, as described in our Privacy Policy.

14. Changes to These Terms

We may update these Terms from time to time, for example when we add a feature to the game, when we change how something works, or when the law changes.

Small changes take effect as soon as they are posted. If a change materially affects your rights, we will announce it in our site news at least 30 days before it takes effect, so that you have time to read it and decide what you want to do. We always update the "Last Updated" date at the top of this page as well, so you can see at a glance when the Terms last changed.

If you keep using Sylestia after a change has taken effect, you are accepting the updated Terms. If you would rather not accept them, you can stop using Sylestia at any time. Section 10 explains how to close your account.

We encourage you to look over this page from time to time so that nothing in it comes as a surprise.

15. Contact Us

If you have a question about these Terms, or about anything else to do with your account, please get in touch through our Contact Us page. We read everything that comes in.

If you need to report a player for breaking these Terms, please contact our staff rather than raising it publicly on the forums. That gets it looked at faster and it keeps the situation from escalating.

For questions about your personal information, your privacy rights, or a privacy request, please see the contact section of our Privacy Policy.

Copyright notices and counter notices go to our designated copyright agent rather than through this page. Our Copyright and DMCA page carries the takedown form and the agent's details. Section 9 sets out what each kind of notice has to contain.
